Introduction

According to the Law on Bidding 2023 (effective from January 1, 2024), Decree 24/2024/ND-CP (effective from February 27, 2024), and Circular 07/2024/TT-BYT (effective from May 17, 2024), the selection of drug supply contractors can be carried out through various forms, including:

1.  How important are the legal documents to the businesses and the market?

The 2023 Bidding Law, along with the newly issued decrees and circulars, has established a comprehensive legal framework for implementing drug bidding. For hospitals, these regulations will reduce hesitation in organizing bidding according to the Bidding Law, which previously stemmed from a lack of clear instructions. Notably, the price negotiation list now includes more drugs, medical equipment, and supplies, with reviews and updates every two years instead of every four.

2.  Meet expectations. Any concern?

The circular also acknowledges the right of medical facilities to purchase and sell drugs not covered by health insurance, catering to patient needs. This change significantly impacts hospitals, granting them more freedom to buy drugs outside the insurance list, and provides opportunities for various drug distribution businesses to sell their products to hospitals.
